AMENDING THE BEVERLY HILLS MUNICIPAL CODE REGARDING THE OFFICE OF CITY AUDITOR. Second Reading – For Adoption.

Comment: The proposed ordinance establishes the Office of the City Auditor.


4.
AMENDING THE BEVERLY HILLS MUNICIPAL CODE REGARDING THE TERM OF THE METROPOLITAN WATER DISTRICT REPRESENTATIVE. First Reading - For Introduction.

Comment: This item amends the term of appointment of representatives to the Board of Directors of the Metropolitan Water District of Southern California to five years.



RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS:

APPOINTING REPRESENTATIVES TO THE BOARD OF DIRECTORS OF THE METROPOLITAN WATER DISTRICT OF SOUTHERN CALIFORNIA (BARRY PRESSMAN AND JEFF WOLFE).

Comment: This item appoints Barry Pressman and Jeff Wolfe to a five-year term and the subsequent five-year term, respectively.

FIXING THE RATE OF TAXES TO PAY THE BONDED AND OTHER VOTER-APPROVED INDEBTEDNESS OF THE CITY FOR THE FISCAL YEAR 2017/2018.

Comment: In accordance with the provisions of Article XIIIA of the Constitution of the State of California, the City may levy an annual tax rate for the repayment of principal and interest on general obligation bonds and other voter-approved indebtedness. This rate is in addition to the general rate of 1% of full market value authorized in the above-noted Constitution article. Expenditures recoverable under this provision reflect the costs of retirement benefits for public safety personnel as approved by voters in an election in 1974. For Fiscal Year 2017/2018, the expenditures for public safety retirement benefits which can be recovered by the property tax override equal $7,488,542.86.

WAIVING CERTAIN FEES FOR SIGNAGE ON SOUTH SANTA MONICA BOULEVARD DURING THE SANTA MONICA BOULEVARD RECONSTRUCTION PROJECT.

Comment: This resolution memorializes the direction provided to staff at the August 8, 2017 City Council meeting to waive certain fees for signage on South Santa Monica Boulevard during the Santa Monica Boulevard Reconstruction Project.

ADOPTION OF THE STATEMENT OF INVESTMENT POLICY FOR FISCAL YEAR 2017/18.

Comment: Staff recommends that the City Council approve the Investment Policy for Fiscal Year 2017/18.


9.
AFFORDABLE HOUSING COVENANT AND REGULATORY AGREEMENT FOR THE PROJECT LOCATED AT 9265-9269 BURTON WAY.

Comment: Development of the project at 9265-9289 Burton Way included approval of a density bonus which requires recordation of a covenant memorializing the affordable housing restrictions applicable to the two very-low income housing units included in the project.  Approval and recordation of the covenant and agreement will satisfy the conditions of approval requiring documentation of the affordable housing requirements. 


10.
AN AGREEMENT WITH DIEGO CEVALLOS D.B.A. BEVERLY HILLS AQUATICS FOR SWIM INSTRUCTION AND PROGRAMS THROUGH THE CITY'S  COMMUNITY SERVICES DEPARTMENT; AND 

APPROVAL TO ISSUE A BLANKET PURCHASE ORDER FOR A NOT-TO-EXCEED AMOUNT OF $280,000 FOR THE SERVICES DESCRIBED ABOVE.

Comment: Staff recommends that City Council approve a one-year agreement with option for one additional one-year extension with City Manager or his designee approval; and approval of a Blanket Purchase Order for vendor to provide youth and adult swim lessons, adult exercise classes, swim camps and youth swim team programs at the Beverly Hills High School in the amount not to exceed $280,000 per year.


11.
AN AGREEMENT WITH EVERBRIDGE, INC FOR LICENSING OF THE CITY’S MASS NOTIFICATION SYSTEM AND RELATED SERVICES.

Comment: Staff recommends that the City Council approve an Agreement with Everbridge, Inc. for licensing of the City’s Mass Notification System and related services, for $34,165.37 each year, and a 3-year total of $102,496.11. 


12.
AGREEMENT WITH PASICH LLP, FOR SPECIAL COUNSEL SERVICES RELATED TO CERTAIN LITIGATION MATTERS.

Comment:  Liner, LLP has been providing legal services to the City related to insurance coverage matters.  Kirk Pasich and Michael Gehrt have left Liner LLP and formed a new firm, Pasich LLP.   The City desires to continue having Kirk Pasich and Michael Gehrt provide special counsel services related to insurance coverage matters.


13.
AMENDMENT NO. 2 TO THE AGREEMENT WITH FEHR & PEERS TRANSPORTATION CONSULTANTS FOR AS-NEEDED TRAFFIC CONSULTING SERVICES; AND

APPROVAL OF AN APPROPRIATION OF $125,000 FROM THE AVAILABLE GENERAL FUND BALANCE; AND

APPROVAL OF A CHANGE ORDER IN THE AMOUNT OF $200,000 FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $600,000.

Comment: This amendment will allow Fehr and Peers Transportation Consultants to perform as-needed consulting services through Fiscal Year 2017-18. This includes studies related to the Metro Purple Line Extension in the amount of $125,000 which will be fully reimbursed by the Los Angeles County Metropolitan Transportation authority; and $75,000 for on-call services that will be funded from Community Development's approved general fund budget.

A PURCHASE ORDER TO PIERCE MANUFACTURING, INC. IN THE NOT-TO-EXCEED AMOUNT OF $2,278,689.54 FOR PURCHASE OF ONE (1) PIERCE ARROW XT 1500 GPM TRIPLE COMBINATION PUMPER AND ONE (1) PIERCE ARROW XT 107’ TRACTOR DRAWN AERIAL.

Comment: Staff recommends that the City Council (1) waive the bidding requirements as the new equipment must match existing Pierce Fire Suppression Equipment currently in operation, (2) move to approve a purchase order in the amount of $2,278,689.54 for the purchase of one (1) Pierce Arrow XT 1500 GPM Triple Combination Pumper and one (1) Pierce Arrow XT 107' Tractor Drawn Aerial currently assigned to the Beverly Hills Fire Department (BHFD) Emergency Response Services Division.

APPROVAL OF A CHANGE PURCHASE ORDER TO RICHARDS, WATSON & GERSHON, A PROFESSIONAL CORPORATION, FOR SPECIAL SERVICES RELATED TO RENT CONTROL.

Comment: Staff recommends City Council move to approve Amendment No. 1 to Agreement 159-15 with Richards, Watson & Gershon, which increases the monthly retainer fee by three percent (3%) and establishes an hourly rate for legal services related to rent control program administration. Staff also recommends City Council move to approve a change purchase order in the amount of $200,000 to cover estimated costs for special legal services related to rent control program administration.


2.
AMENDMENT NO. 1 TO EMPLOYMENT AGREEMENT BETWEEN THE CITY OF BEVERLY HILLS AND MAHDI ALUZRI.

Comment: Pursuant to the City Manager’s employment agreement, the City Council reviews the performance and compensation of the City Manager annually. The attached amendment to the agreement presents a pay for performance bonus of 2.7%.  This represents the change in the cost of living as of April 1, 2017.
