ORDINANCE OF THE CITY OF BEVERLY HILLS:

ESTABLISHING MANDATORY STANDARDS FOR EARTHQUAKE HAZARD REDUCTION IN EXISTING WOOD-FRAME BUILDINGS WITH SOFT, WEAK, OR OPEN-FRONT WALLS, AND AMENDING TITLE 9 OF THE BEVERLY HILLS MUNICIPAL CODE. Second Reading – For Adoption.

Comment: This ordinance sets forth mandatory provisions for the scope and compliance requirements by which property owners of existing wood-frame multi-family buildings will be required to retrofit their potentially vulnerable buildings and increase measures of occupant safety.

AN UNCODIFIED ORDINANCE EXTENDING THE TERM OF ONE MEMBER OF THE PLANNING COMMISSION (ALAN ROBERT BLOCK).  First Reading - For Introduction.

Comment: This ordinance extends the term of Planning Commissioner Alan Robert Block for one year from July 1, 2019 through June 30, 2020.



RESOLUTION OF THE COUNCIL OF THE CITY OF BEVERLY HILLS:

APPROVING THE FINAL MAP FOR TENTATIVE TRACT MAP NO. 63541 (8600 WILSHIRE BOULEVARD); AND 

APPROVING A SUBDIVISION IMPROVEMENT AGREEMENT WITH 8600 WILSHIRE BOULEVARD, LLC.

Comment: This is a request for City Council adoption of a resolution approving the final map for Tract Map No. 63541. Additionally, since the public improvements associated with this subdivision have not been completed, a subdivision improvement agreement between the City and 8600 Wilshire Boulevard LLC, is required to ensure compliance with conditions of approval.


8.
FOR THE ACCEPTANCE OF A GRANT UNDER THE FISCAL YEAR 2017 STATE HOMELAND SECURITY PROGRAM (SHSP 17) AND APPROPRIATING FUNDS FOR THE FIRE DEPARTMENT’S URBAN SEARCH AND RESCUE (USAR) FOR $20,000, SMART CLASSROOM SERVICE WARRANTY FOR $50,000, AND MOBILITY EXERCISE (MOBEX) FOR $4,000.

Comment: The Fire Department has been awarded $74,000.00 towards Mobility Exercise, purchase of the Smart Classroom software, and Urban Search and Rescue (USAR) training. The City will be reimbursed by the County of Los Angeles for all authorized SHSP grant expenditures by the Fire Department.

Comment: Appoints Jennifer K. Schreiber to the Architectural Commission, Deborah Frank to the Fine Art Commission, and Amie Sherry to the Recreation and Parks Commission for an initial two-year term each.

REAPPOINTING A MEMBER TO THE DESIGN REVIEW COMMISSION (BARRY I. BERNSTEIN).

Comment: Reappoints Commissioner Barry I. Bernstein to the Design Review Commission for a four-year term.


11.
AFFORDABLE HOUSING COVENANT AND REGULATORY AGREEMENT FOR THE PROJECT LOCATED AT 309-325 SOUTH ELM DRIVE AND DEEDS OF TRUST FOR THREE AFFORDABLE HOUSING UNITS.

Comment: Staff recommends that the City Council approve the Affordable Housing Covenant and Regulatory Agreement for the project located at 309-325 South Elm Drive.


12.
AGREEMENT WITH THERESA SIMMONS, AGNP-BC FOR THE CONTRACT NURSE PRACTITIONER FOR THE BEVERLY HILLS FIRE DEPARTMENT; AND

APPROVAL OF A PURCHASE ORDER FOR FY 18/19 FOR $93,600.00.

Comment: The Beverly Hills Fire Department (BHFD) is developing a Nurse Practitioner Response Unit (NPRU) to complement its traditional emergency medical service (EMS) model. The nurse practitioner provides direct patient care to the ill and injured in the field, assists patients in their ability to access various healthcare resources, provides follow-up care and serves as a community liaison to the program.


13.
AMENDMENT NO. 1 TO THE AGREEMENT WITH BYRON EPP, INC. TO FURNISH LABOR AND MATERIALS FOR THE PURCHASE AND INSTALLATION OF THE FOUR-FOLD DOOR SYSTEMS AND COMPONENTS FOR FIRE STATION 1, FIRE STATION 2, FIRE STATION 3; AND

APPROVAL OF A PURCHASE ORDER FOR FY 18/19 FOR $1,497,154.32.

Comment: Previously, the City Council approved Agreement 662-18 on October 16, 2018. Owing to oversight, the vendor inadvertently neglected to account for the additional back door at Fire Station 3. As a result, both quantity and pricing has to be adjusted.

AMENDMENT NO. 5 TO THE AGREEMENT WITH RINCON CONSULTANTS, INC. FOR THE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT FOR THE 9908 SOUTH SANTA MONICA BOULEVARD CONDOMINIUM PROJECT; AND

APPROVAL OF A CHANGE PURCHASE ORDER IN THE AMOUNT OF $14,020.00, FOR A TOTAL NOT-TO-EXCEED AMOUNT OF $147,630.00.

Comment: Request to approve a 5th contract amendment for environmental consulting services related to the proposed mixed use condominium project located at 9908 South Santa Monica Boulevard. All contract fees are paid for by developer.


15.
A TRANSFER OF AN APPROPRIATION OF $600,000 FROM PARKING ENTERPRISE FUND BACK TO CAPITAL ASSETS FUND.

Comment: Staff recommends City Council move to approve a transfer of an appropriation of $600,000 from the Parking Enterprise Fund (810) back to the Capital Assets Fund (405) to cover ongoing Facilities Maintenance needs.

A CONTINUATION OF DECLARATION THAT THE PUBLIC INTEREST AND NECESSITY REQUIRES CERTAIN WORK TO BE PERFORMED WITHOUT COMPETITIVE BIDDING PURSUANT TO PUBLIC CONTRACT CODE SECTIONS 22035 AND 22050.

Comment: The City is managing a project to plug oil wells on Beverly Hills Unified School District property. Pursuant to Public Contract Code 22050, at each regularly scheduled meeting, City Council shall determine, by four-fifths vote, that there is a need to continue the project without competitive bidding until the project is completed.

CITY COUNCIL REVIEW OF THE PLANNING COMMISSION’S DECISION TO APPROVE A HILLSIDE R-1 PERMIT TO ALLOW MORE THAN 1,500 CUBIC YARDS OF EARTH MATERIAL TO BE IMPORTED OR EXPORTED FROM A SITE IN THE HILLSIDE AREA THAT IS IMMEDIATELY ADJACENT TO A STREET THAT IS LESS THAN TWENTY FOUR FEET (24’) WIDE; A HILLSIDE R-1 PERMIT TO ALLOW FOR CUMULATIVE FLOOR AREA GREATER THAN 15,000 SQUARE FEET, AND; A HILLSIDE R-1 PERMIT TO ALLOW AN ACCESSORY STRUCTURE TO BE LOCATED WITHIN 100’ OF THE FRONT PROPERTY LINE ON AN ESTATE LOT ASSOCIATED WITH THE REMODEL AND ADDITION WORK TO THE SINGLE-FAMILY RESIDENCE LOCATED AT 1115 CALLE VISTA DRIVE.

Comment: On September 13, 2018, the Planning Commission approved three Hillside R-1 Permits associated with the remodel and addition work to the single-family residence located at 1115 Calle Vista. On October 9, 2018, the City Council voted to call the matter up for review. Accordingly, this will be a de novo hearing before the City Council on the requested Hillside R-1 Permits to allow the remodel and addition work to the single-family residence. The Planning Commission found that the project was exempt from the provisions of the California Environmental Quality Act (CEQA) and the City Council will also consider the exemption.

AN ORDINANCE OF THE CITY OF BEVERLY HILLS AMENDING CHAPTER 6 (SHARED MOBILITY DEVICES) OF TITLE 7 (TRAFFIC, PARKING, AND PUBLIC TRANSPORTATION) OF THE BEVERLY HILLS MUNICIPAL CODE TO EXTEND THE PROHIBITION ON SHARED MOBILITY DEVICES BEING PLACED IN ANY PUBLIC RIGHT-OF-WAY OR ON PUBLIC PROPERTY, OPERATED IN ANY PUBLIC-RIGHT-OF-WAY OR ON PUBLIC PROPERTY, OR OFFERED FOR USE ANYWHERE IN THE CITY.  First Reading - For Introduction.

Comment: Staff recommends City Council adoption of an ordinance that would continue the prohibition of shared mobility devices in the City for an additional twelve months.
