Construction & Land Use Project Review Medical Use
Medical Use

The City adopted  Ordinance 11-O-2602 regarding medical use in Beverly Hills on January 11, 2011, and it went into effect February 11, 2011.

The medical use ordinance allows continued operation of existing, legal medical uses but property owners wishing to add or expand medical use are required to do one of the following:

  1. Apply for a medical use overlay zone for their property
    OR
  2. Qualify for an exception to the medical use overlay zone by meeting certain conditions.

1.  Medical Overlay Zone

Application of the medical use overlay zone (refer to Section 13 of the ordinance) to a specific property would be reviewed by the Planning Commission and approved by the City Council with findings that the medical use would not have negative impacts and would provide a public benefit.

2.  Exception

The medical use ordinance includes an exception (Section 7 of the ordinance) for existing buildings that already have legal medical use to convert up to 6,000 square feet of commercial office use to medical use if certain conditions are met.

Both the medical use overlay zone and the exception require certain parking requirements to be met and include prohibitions and restrictions on ground floor medical use.

Medical Use Building Registration
IMPORTANT NOTE: Deadline for submittal of registration packet to City has been extended to 1/13/2012.

The medical use ordinance requires owners of commercial buildings with existing, legal medical use to register the building(s) with the City in order to take advantage of the exception to the Medical Overlay Zone or to take advantage of the following:

  • Redistribution of medical office space within a building
  • Future re-establishment of medical use in a building if the total amount of medical space in the building does not exceed the amount that existed legally in the building on February 11, 2011
