Telecommunications Site Leases

This web page is intended for telecommunications providers with existing leases or site license agreements on City-owned property and not in the public right-of-way. 

The City of Beverly Hills has various leases and site license agreements for antenna and other telecommunications equipment with AT&T, T-Mobile, and Verizon.  The City's Real Estate Management team manages all such contractual arrangements located on City-owned property and not in the public right-of-way.

Email correspondence regarding a contractual arrangement on City-owned property not in the public right-of-way should be directed to BHPropertyManagement@beverlyhills.org. All consultants, contractors, vendors, etc. working on behalf of a telecommunications provider must include a letter of authorization from the respective telecommunications provider along with their initial communications to City staff at the above-referenced email address.

Site Access

Process

  1. Provide a general description of the purpose of the visit with at least five (5) business days' advance written notice to BHPropertyManagement@beverlyhills.org. City staff will endeavor to accommodate your access request as best as possible.
  2. Provide a letter of authorization, if working on behalf of a telecommunications provider.
  3. For access to antenna equipment at the Police Department located at 464 N. Rexford Drive, the City requires at least ten (10) business days' advance written notice. All individuals are required to undergo a background check. For each individual, include the following in your request: 
    • Contractor/Sub-Contractor Name
    • Business Address
    • Employee Name
    • Employee Date of Birth
    • Driver's License State
    • Driver's License Number
    • Access Date(s)
    • Hours of Work
    • General Description of Purpose of the Access
    • Be prepared and have backup dates or employees to keep your project on time in the event a background check does not clear.

Installation Work

Process

  1. Prior to proceeding with construction or installation work, all contractors must submit the following to BHPropertyManagement@beverlyhills.org:
    • Certificates of insurance evidencing the minimum coverages as outlined here
    • A detailed construction schedule
    • Copies of all permits obtained in connection with the construction or installation work.
  2. City staff will review the coverages and construction schedule. Work shall not proceed until City staff provides written authorization to proceed.
  3. Prior to proceeding with any work or submitting any applicable plans for permitting, you must obtain Landlord approval, following the processes set forth below. 

Proposed Alterations Modifications Pursuant to an Existing Contractual Arrangement or Plans for a New Site

Process

  1. Provide a letter of authorization, if working on behalf of a telecommunications provider.
  2. Provide detailed construction documents that show the proposed scope of work.
  3. Email the construction documents to BHPropertyManagement@beverlyhills.org
  4. City staff will review and respond as time allows and in accordance with parameters set forth in each contractual arrangement. If approved, City staff, acting as Landlord under each contract, will provide a letter stating such approval of the construction documents.
  5. After obtaining landlord approval of the work, the telecommunications provider must submit the plans for Community Development Department review, subject to BHMC 10-3-45.  

 

Notes/City Requirements

  • If the proposed alteration or modification is not authorized under an existing contractual agreement, an amendment and rent adjustment must be proposed and reviewed by City staff pursuant to the process described above.
  • For projects that replace or add antennas, a radiofrequency exposure report that states the proposed configuration complies with FCC regulations must be submitted along with the construction documents.  
  • A structural analysis of any brackets supporting equipment shall be provided along with construction documents.
  • For projects that remove brackets or other infrastructure from a building façade, details for the patching and painting of holes shall be included in construction documents.
  • Waterproofing details shall be included with construction documents for any work involving rooftop or façade penetrations.
  • Landlord may impose other rules or requirements as deemed appropriate for the proposed work.

Process

  1. Provide a letter of authorization, if working on behalf of a telecommunications provider.
  2. Email notice/proposal to BHPropertyManagement@beverlyhills.org
  3. City staff will review and respond as time allows and in accordance with parameters set forth in each contractual arrangement.
  4. If proposing a new site/contract, you must also submit detailed plans in accordance with the process set forth above for proposed alterations or modifications.

 

Notes/City Requirements

  • All new contracts and amendments are drafted by the City on a City approved form. City staff will not approve deviations from the City form.
  • City staff does not typically recommend new agreements or negotiated renewals for terms longer than five years.
  • For proposals seeking to add equipment to expand services or otherwise increase coverage, the City may request a propagation map comparing existing coverage to proposed coverage.
