Water Conserving Plumbing Fixtures BHMC (Ordinance Number 09-O-2561)

On January 6, 2009 the City Council adopted the Water Conservation Plumbing Fixture Standards, Water Efficient Landscaping Ordinance. The ordinance is effective beginning February 6, 2009.

 Ordinance Requirements:
  • Effective Date: February 6, 2009
  • Applicable to new plumbing fixture installations and/or replacements on all properties.
  • Required prior to change of ownership.  (Sale of Property)
  • Plumbing Permit is required.
  • Affidavit must be submitted at the time of sale.

1. Does this affect my property?
Answer:
All property types in the City of Beverly Hills are required to comply with Water Conservation Ordinance 09-O-2561.

2. When did this law become a requirement?

Answer: This law was approved the Beverly Hills City Council on January 6, 2009 and became effective on February 6, 2009.

3. Do I need a Plumbing Permit? 
Answer:
Yes, if plumbing fixtures are being replaced.  

4. Can a homeowner pull the permit? 

Answer: Yes, a property owner can pull the permit for single family residential properties only. Commercial and multifamily properties permits require a licensed contractor to pull the required permits.

5. Who needs to fill out the affidavit? 
Answer:
 Both the seller and the buyer are required to complete the affidavit form.

6. Why does the affidavit have smoke detector compliance information on it? 
Answer:
 One document has been created to simplify the process requiring one affidavit in a single page document.

7. Does the City of Beverly Hills have special smoke detector requirements to verify for the affidavit?
Answer:
 The City of Beverly Hills Municipal Code (BHMC) requires all smoke detectors are hardwired, using the primary electrical source from the electrical system of the property. For more details review the BHMC section 907.2.10.2.

8. When do I submit the affidavit? 
Answer:
 The affidavit should be submitted after all plumbing fixtures are verified as being in compliance with the Water Conservation Ordinance 09-O-2561

9. Can I use an aerator instead of replacing the faucet fixture? 
Answer:
Yes, aerators in compliance with section 301.0 of the 2007 California Plumbing Code, other applicable codes, and the Water Conservation Ordinance 09-O-2561. Aerators shall comply with the maximum required gallon per minute (GPM) water flow. The aerator GPM flow is required to be visible and verifiable at all times.

10. What if an aerator is not compatible with the faucet fixture? 
Answer:
When an aerator is not compatible with an existing fixture the entire plumbing faucet fixture must be replaced with fixtures in compliance.

11. Are flow-restricting devices acceptable?
Answer:
Flow restrictors are allowed with manufacturer documentation identifying compliance. Licensed Professional performance tests are an acceptable method of compliance.

12. Do I have to replace the historical plumbing fixture on the property? 
Answer:
 Only registered historical properties are exempt and must submit for and receive approval of from the Building and Safety Division prior to any change of ownership. Only written requests will be reviewed and assessed on an individual basis. An inspection of the property may be required.

13. How much does the permit cost? 
Answer:
 Permit costs are based on the cost of materials and labor for the proposed work. To determine the cost your permit(s) view M-E-P Plan Check and M-E-P Permit information on the Building Fee Schedule located on the Building & Safety fees and taxes web page.

14. Do I need to get an inspection on the plumbing fixture upgrades? 
Answer:
 Yes, all plumbing fixtures replacements require inspection.

15. How do I get an inspection?
Answer:
 You can only schedule an inspection when you have a permit. Review your permit document for step by step instructions or log in to your MyOBC account to schedule an inspection online.

16. Do we need more than one permit to modify the plumbing water supply and waste water piping system to be compatible with the new low flow plumbing fixture?
Answer: No, your plumbing permit description (scope of work) can include the modification of the required piping systems with the plumbing fixture replacements.

17. Is more than one affidavit required?
Answer:
 One affidavit shall be provided for every separate building or structure on the property. 
    EXAMPLE: One affidavit is required for the main structure and an additional affidavit is required for the detached garage structure.

18. When do I submit the affidavit? 
Answer:
 The affidavit should be submitted after all plumbing fixtures are verified as being in compliance with the Water Conservation Ordinance 09-O-2561
